Below are the terms and conditions that bind you on using PageUp PR Network’s services:
- Use
- You bear the sole responsibility of the content (news copy and related information) submitted and its accuracy. It is not possible on the part of PageUp PR Network to check the accuracy of each and every press release material submitted to it and hence PageUp PR Network shall not be held responsible for verification of facts in the press releases.
- PageUp PR Network reserves the discretionary power to reject any press release or publish it after considerable editing. PageUp PR Network also has the right to permanently remove a press release that has been published on its network, to inhibit the distribution of a press release and to deny sanction to a press release. However, PageUp PR Network isn’t responsible for situations wherein a press release is removed from any site other than PageUp PR Network.
- PageUp PR Network is responsible for accurate and on time publication of submitted press releases. PageUp PR Network does not charge any extra amount to mend an error made by PageUp PR Network inadvertently and considers such correction as its obligation.
- Submitters should supplement their content with a contact name, contact number as well as e-mail address that shall be accepted upon verification by PageUp PR Network.
- PageUp PR Network neither guarantees a press release’s specific placement nor publishes a press release submitted or manipulated by a third party. However, it makes the published press release available to third parties for manipulation (whether unintentional or intentional) by means of online distribution media.
- Users of PageUp PR Network’s service shall abide by the terms of using the services only for intended purpose instead of any illegal purpose. Illegitimate use of the services shall include reverse engineering of PageUp PR Network’s processes and/or the site as a whole, as the case may be and including PageUp PR Network’s processes in an imitative service. Users devoid of PageUp PR Network’s express-written consent shall have no access to its systems and hold no right for query.
- Suspension or Termination
PageUp PR Network holds the sole right to either defer or terminate a user’s account at any point in time. In case a user’s account becomes aberrant or the user breaches any terms of service stated herein, PageUp PR Network holds the right to even defer the user’s access to PageUp PR Network’s service.
Users found to be repetitively violating the terms of service stated herein shall succumb to either or all of the below mentioned:
- The user’s account may be frozen permanently and in case of pre-paid account the unused credits will be held by PageUp PR Network for covering the expenditure on removing those illegitimate press releases from the Web, where so ever PageUp PR Network had submitted them. The freezing of account and holding back of unused credits are in addition to the non-issuance of credit back or refund.
- The firm or individual, found to be repetitively violating the terms of PageUp PR Network’s service, shall be liable to be banned. PageUp PR Network shall ban their IP addresses, the credit cards used to make payments for the press releases and prohibit such users from putting up either paid or free press releases on PageUp PR Network’ network.
- To prove its veracity to public, PageUp PR Network can also deem it justifiable to publish on its network the complaints against alleged press releases accompanied with supporting evidences and all other relevant materials.
- Billing
- All fees/charges/bills have to be paid by the user complying with the terms of fees/charges/bills effective at the time when the user’s fee/charge/bill is due. PageUp PR Network does not make provisions for cancelling a payment obligation and/or refunding the amounts paid. Users can make payments via 2Checkout as well as PayPal and does not reserve any information regarding credit card and billing to it. PageUp PR Network has the discretionary power to revise its fees/charges or introduce new charges at any point in time.
- PageUp PR Network takes strict action against any controversial and abhorrent press releases published on PageUp PR Network’s network. If a press release is proved via complaints & sufficient evidences to have even remote adverse impacts on third party interests then it gives sufficient reason to PageUp PR Network to permanently remove it from its network.
Such a featured press release that has been taken out of PageUp PR Network’s network on account of complaints against it is not liable to any credit backs or refunds. On no grounds do such press releases stand a chance for credit back on which our potential staff had to work for incurring expenses and had to be removed from the PageUp PR Network’s network owing to lawful complaints against them. The work of the PageUp PR Network staff includes meticulous customization and crafting out of the press releases; careful selection and addition of media into them; embedding of contextual links onto them; creation of DOC versions, PDF versions and other printable versions and publishing of the press releases on PageUp PR Network’s network, its blogs and forums, as well as third-party media clients. Because of such orderly rendering of service, any credit back or refund is impossible if the clients’ press releases come into any dispute with a third party. Valid complaints lead to removal of illegitimate press releases from each and every place on the Web where PageUp PR Network had published them on and it accounts for out-of-budget expenses for PageUp PR Network. Hence, such users are deprived of their refunds/credit backs.
- Users are requested to furnish complete and valid contact as well as billing information. In case of any change or updating, users should do that within a month of providing the details. If the contact/billing information furnished by the user is found to be false, PageUp PR Network shall immediately terminate the user’s access to the services of PageUp PR Network, apart from initiating other necessary legal remedies.
- All fees/charges/bills shall be accounted in US Dollars unless agreed upon by PageUp PR Network.
- Warranties
- All users of PageUp PR Network’s services shall give warranty that
- It is their duty as well as right to render the submitted press releases on the network of PageUp PR Network.
- They shall comply with the laws upheld by and rules made by PageUp PR Network that includes but is not restricted to Children's Online Privacy Protection Act (1998) and those laws that relate to spam.
- The press releases submitted by them shall not contain any defamatory, obscene, misleading, false, libelous content that violates copyright law, right to publicity, right to privacy and any other human right.
- PageUp PR Network does not give any warranty (either implicit or explicit), inclusive of but not restricted to implicit warranty of merchantability, warranty of conditioned for particular purpose or title and any other such warranty related to trade usage, path of dealing and of performance and statute. PageUp PR Network does not give any warranty for error-free service, deletions, loss or delay and mechanical or human defects.
- If at all PageUp PR Network concerns itself with any sort of damage it is the actual direct damage to the user arising from the user’s use of PageUp PR Network’ service, not considering the cause. Also, the actual direct damage shall not surpass the amount paid by the user in lieu of the service in duration of 12 months prior to the month of arising of cause of action. PageUp PR Network, under no circumstances, shall be answerable to any demands made by a third party or in case of lost savings, lost profit, loss of use, business loss and/or other special, consequential, exemplary, indirect, incidental and punitive damages even if PageUp PR Network had been warned of such possible damages.
- Indemnification
- PageUp PR Network shall act as an indemnitor and protect the user (indemnitee) against demand or claim made by third parties. Such claims include without restriction attorney fees stating that PageUp PR Network’s service breach intellectual property right formulated by the U.S. Law. However, PageUp PR Network does not indemnify the user in cases of third party claims arising out of
- service modifications done neither by PageUp PR Network nor its authorized contractors,
- use of PageUp PR Network’ service in collaboration with an equipment and/or software unrecognized by PageUp PR Network,
- use of PageUp PR Network’s service in compliance with the set terms of service.
- In case of any violation of the warranties/representation or violation of submitted press releases stated herein, the user as an indemnitor shall indemnify PageUp PR Network (in this case an indemnitee) along with its allied companies as well as third-party vendors and distributors against/from any claim of loss, damage, expense, cost and liability (inclusive of attorney fee).
- Indemnification is bound by the following conditions:
- The indemnitee shall provide on-time notification regarding any claim to the indemnitor
- The indemnitor shall be in control of all defense mechanisms and settlement negotiations
- The indemnitee shall cooperate with the indemnitor with regards to expenses on defense mechanisms and in furnishing relevant evidences
- In case of any impending or actual claim with respect to PageUp PR Network’s service and alleging breach, PageUp PR Network in its discretion shall
- endow the user with the right to continue with the use of PageUp PR Network’s service
- amend or replace the service to make it non-violating
- terminate the service use completely or in portion after promptly notifying the user of the same. In such a case, PageUp PR Network shall be liable to refund the user the prorated part of prepaid fees.
- Miscellaneous
- PageUp PR Network facilities are provided under State and Federal regulations.
- PageUp PR Network, PagUp Press Release Network are trademarks or registered trademarks of PageUp PR Network. And no right or license is granted to use them. Certain content on the network of PageUp PR Network used for operation of its service is patented, copyright protected and trademark protected along with the protection via PageUp PR Network’s (including its licensors’, service providers’ and affiliates’) other such proprietary rights. The users are advised not to
- Use any of such service marks, trademarks and logos or any other content made available by the service in a way contradictory to the mode as specified and approved by PageUp PR Network.
- Deface, alter or modify any such service marks, trademarks and PageUp PR Network’s intellectual property made available through its service. Other implicit rights granted to the user are reserved by PageUp PR Network.
- The users shall not uphold themselves as ‘endorsed by’, ‘sponsored by’ or ‘affiliated with’ PageUp PR Network’s network or any of its affiliates or subsidiaries. Users shall in no case
- Defame PageUp PR Network, its service marks as well as trademarks and even its services
- Translate, modify, adapt, disassemble, decompile and/or reverse engineer PageUp PR Network’s services or any programs or software used in relation to the services.
- Furnishing of e-mail address by the user by default implies that he/she will receive communications related to PageUp PR Network’s services electronically. Such communications include account information, press release submission as well as payment details. Also, submission of contact details by the user shall by default imply that he/she will receive communications related to PageUp PR Network’s services on phone or by post. Any change related to postal address, contact number and/or e-mail address shall have to be notified to PageUp PR Network at info

- Users by default abide by the terms of service of PageUp PR Network when they submit press releases to PageUp PR Network’s network. If the user represents a third party entity, mere subscription of the user to service of PageUp PR Network shall bind that third party entity into the rules and regulations of PageUp PR Network. In case of any violation of the terms of service post subscription by the user, PageUp PR Network holds the discretion to resort to any and/or all legal remedies inclusive of and without restriction to termination of the user accounts irrespective of how many accounts they hold in PageUp PR Network’s network.
- Users shall in connection with the use of PageUp PR Network’s service abide by local laws, state laws, national laws as well as foreign laws. The users’ successors, heirs as well as assigns shall abide by the same laws.
- PageUp PR Network has the discretionary power to modify the terms of service along with its policies at any point in time. Such modifications shall be effective from the moment they are updates on the network. Hence, users are advised to browse through the terms of service at regular intervals. If the user continues using PageUp PR Network’s services even after the due updates on its network, it means by default that the user has consented to such changes.
- PageUp PR Network and users of its services shall be deemed independent contractors. Users shall not proceed with intentions of creating partnership, agency, joint venture or any other employment relationship with PageUp PR Network. Neither PageUp PR Network nor its users are authorized to sign an agreement on the other’s behalf. Also, none of the parties shall be reckoned as an agent of the other party.
- The agreement between PageUp PR Network and users of its services shall be regulated by laws of California, discarding provisions of conflict on laws. Hence, any lawsuit shall be entertained by state or federal courts of the state of California and users shall yield to personal jurisdiction. However, both the parties agree on the non-application of United Nations Convention on Contracts for the International Sale of Goods in this agreement.
